As the Inspector knows (and documents on the examination webpages confirm the details), the Council committed to preparing a revised HRA report in order to comply with the recent EU ruling. We have prepared such a revised report which is now in the form of a full ‘Appropriate Assessment’ (AA) rather than just a ‘Screening’ report. We have liaised with Natural England (NE) in preparing this report, and sent NE a copy of the AA a few days ago. We have subsequently received NE’s reply, which confirms NE’s support for the report. Can I please request that the Report and NE’s letter is added to the website. If necessary, I also have no objection to this email being published alongside the two documents. I would suggest the AA is added to the ‘Core Documents’ library as CD13A (with CD13 (HRA Screening, Nov 2013) retained on the website, but a notation added to confirm it is superseded by CD13A), whilst NE letter is possibly better as an EDxxx document. I appreciate that the session on HRA is coming up next week, and participants at it will unlikely get chance to read the full AA. However, if the Inspector agrees, I think it would be helpful if the programme officer notifies those participants of the availability of the documents (assuming the Inspector agrees to their publication). And, of course, such participants should already be aware that such a report was ‘on its way’, because it has been clearly flagged as such on the examination pages of the website. Precisely how we proceed with the matter of HRA is no doubt something we can discuss as part of the hearing sessions next week (and participants may have views on this, of course), but, overall, the Council is confident that we now have a (post-EU ruling) legally compliant HRA, and that the recommendations in it are addressed, where necessary, by the suggested scheduled of modifications we have already published (modifications as agreed with NE).
